What is Probate?
‘Probate’ (or in Scotland, ‘Confirmation’) is the legal process that allows a personal representative – the ‘executor’ of the Will – to formally deal with the estate.
If a Will has been made, the named executors are responsible for obtaining Probate. Where no Will has been made, the next of kin will usually be the person to do this.
